1. Introduction

These Terms of Service govern your use of the website and services provided by Netgen Entertainment SRL ("Netgen Esports", "we", "us", or "our"), a company registered in Belgium under company number BE0775326443, with its registered office at Clos des Cerisiers 18, 7850 Enghien, Belgium.

By accessing or using our website at www.netgen-esports.com or any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Services

Netgen Esports provides B2B esports solutions including: (a) a white-label esports tournament platform ("Platform"), (b) esports live production services, and (c) gaming event management services. All services are subject to separate agreements and statements of work where applicable.

3. Platform Subscriptions

Platform subscriptions are billed in advance on a monthly or annual basis. All fees are exclusive of applicable taxes. Subscription fees are non-refundable except where required by law. You may upgrade or downgrade your plan at any time; changes take effect at the next billing cycle.

4. Intellectual Property

All intellectual property rights in and to the Platform, our website, and our services remain the property of Netgen Entertainment SRL or our licensors. White-label platform clients retain full ownership of their brand assets and user data. Netgen retains ownership of the underlying platform technology, including Fluxion AI.

5. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR). Our Privacy Policy is available at Privacy Policy.

6. Limitation of Liability

To the maximum extent permitted by law, Netgen Entertainment SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services. Our total liability for any claim arising under these Terms shall not exceed the amount paid by you for the service giving rise to the claim in the twelve (12) months preceding the claim.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Belgium. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Brussels, Belgium.
